Post-Settlement Guide: What Happens After You Win Your Motorcycle Case?

The hard part is over—but you’re not paid just yet.

Here’s what happens after your settlement is reached, and how Fisher and Associates walks you through every step.

You Won. So… What Happens Now?

The negotiation is over. The insurance company has agreed to pay. You’ve finally secured justice after months—or years—of fighting through pain, paperwork, and lowball offers.

But then comes the question no one talks about enough:
“Now what?”

If you’re asking when the check comes, how much you’ll actually receive, or what happens with medical bills and attorney fees, you’re not alone.

At Fisher and Associates, we don’t just fight for the win—we help you understand what happens after the win.

Here’s exactly what to expect after settling your motorcycle injury case in Colorado.

Step 1: Signed, Sealed… but Not Yet Delivered

After the parties have agreed to a settlement, the insurance company will prepare a settlement document that outlines the final terms of your case—and most importantly, includes what you’re being paid and a release of claims.

Once you sign, you agree not to pursue any additional legal action related to the accident.

That’s why we carefully review every settlement document to protect your rights and make sure the terms are clear and fair before anything is finalized.

Step 2: Yes, They Cut a Check—But No, It Doesn’t Go Straight to You (Yet)

Once the settlement/release is signed, the insurance company typically has two to four weeks to issue a check.

That payment is sent to our firm—not directly to you—and deposited into a secure client trust account.

Why? Because before we can release your portion, we must resolve outstanding obligations related to your case—things like:

  • Medical liens
  • Legal fees
  • Court filing costs
  • Expert witness invoices

This ensures everything is handled properly—and that you don’t face surprise bills down the road.

Step 3: Medical Bills Don’t Vanish—But We Work to Reduce Them

Many injured riders in Colorado receive treatment through health insurance, workers’ comp, or on a lien basis. If you owe medical providers after your case settles, those bills must be paid out of your settlement. But here’s the good news: We negotiate those bills down whenever possible. Hospitals, chiropractors, and surgeons often accept less than the full balance—especially when a lawyer is advocating on your behalf. Our goal is to protect your bottom line and work to ensure that you keep more of what you fought for.

Step 4: You Only Pay If You Win—And You Always Know Where Your Money’s Going

At Fisher and Associates, we work on a contingency fee basis. That means:

  • You pay nothing upfront
  • We only get paid if we win or successfully settle your case

Once your settlement funds arrive, our fee—typically a set percentage—is deducted. We also subtract pre-approved case expenses, such as:

  • Police reports
  • Medical records
  • Expert fees
  • Deposition transcripts
  • Filing costs

We provide a full disbursement statement showing every dollar, every deduction, and exactly what’s going to you. Transparency is non-negotiable.

Step 5: The Moment You’ve Been Waiting For

Once liens are paid, fees are deducted, and all balances are settled, we issue your compensation check.

You’ll receive all of the remaining funds. For most clients, this happens 30–45 days after the settlement is signed, though some cases move faster depending on the insurer and lien complexity.

Don’t Just Cash the Check—Plan for Your Future

A motorcycle settlement isn’t just about replacing your bike or paying a few hospital bills. It’s often about restoring a life that was knocked off course.

Before spending the funds, consider:

  • Paying off medical debt or high-interest accounts
  • Funding additional rehab or medical care
  • Setting aside money for income gaps or future treatment
  • Speaking with a financial advisor

Our job is to help you get what you deserve. Your job is to use it to rebuild—and to protect your future.

We’re Not Done When the Case Ends—We’re Still Your Legal Team

Some firms disappear the moment the check clears. That’s not how we operate. At Fisher and Associates, we stay available long after the case concludes to answer questions, help you handle medical paperwork, or provide referrals for other legal issues you might face.
